Welcome to Vaerfel Idle. These Terms of Service govern your access to and use of the Vaerfel Idle website, game, and related services operated by Fractal Ledger.
By accessing or using the service, you agree to these Terms. If you do not agree, do not use the service.
1. Eligibility
You must be at least 13 years old to use Vaerfel Idle. By using the service, you represent that you meet this requirement and that you are legally able to agree to these Terms.
2. Your Account
You may need an account to access some features. You are responsible for maintaining the security of your account and for activity that occurs under it. You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity that occurs through your account unless caused by our own misconduct or failure to use reasonable safeguards.
3. Acceptable Use
You agree not to:
– cheat, exploit bugs, or use unauthorized automation
– harass, threaten, abuse, or impersonate other players
– interfere with the normal operation of the service
– attempt to gain unauthorized access to accounts, systems, or data
– use the service for unlawful, fraudulent, or harmful purposes
– upload or transmit malicious code or harmful content
We may suspend or terminate accounts that violate these Terms or harm the service, community, or other players.
4. Game Status; Alpha/Beta Content
Vaerfel Idle is an evolving live game and may include alpha, beta, test, or incomplete systems. Features may change, break, be removed, or reset at any time.
We reserve the right to modify or wipe game data, progression, balances, items, currencies, systems, and other gameplay-related content during alpha, beta, testing, balancing, technical maintenance, or live operations.
Unless otherwise required by law or expressly stated by us, gameplay progress and non-paid in-game state are not guaranteed to persist.
5. Virtual Content, Premium Currency, and Paid Cosmetics
Any virtual items, cosmetics, currencies, unlocks, or similar digital content made available through the service are licensed, not sold.
Players do not obtain ownership rights in virtual content. Virtual currency has no cash value, is not redeemable for money, and is a limited license to use eligible digital content within the service.
All purchases of virtual currency and digital items are final and non-refundable except where required by applicable law. Once virtual currency has been redeemed or a digital item has been delivered to your account, the transaction is final except where required by law.
If paid cosmetics are offered in the future, they are generally intended to remain associated with the applicable account while that account remains in good standing, subject to these Terms, technical limitations, fraud review, chargebacks, service changes, content retirement, and continued service availability.
We may modify, rebalance, replace, retire, suspend, revoke, or remove virtual content at our discretion, subject to applicable law.
6. Intellectual Property
The service, including its game content, artwork, design, code, branding, music, text, and other materials, is owned by Fractal Ledger or its licensors and is protected by applicable intellectual property laws.
You may not copy, distribute, modify, reverse engineer, sell, or exploit the service or its content except as expressly permitted by us or by law.
7. Third-Party Services
The service may rely on third-party providers such as Google, Firebase, hosting providers, payment providers, or other infrastructure and platform services. Your use of those components may also be subject to third-party terms and policies.
We are not responsible for third-party services beyond our reasonable control, though we may depend on them to operate the service.
8. Termination and Suspension
We may suspend, restrict, or terminate access to the service, with or without notice, if:
– you violate these Terms
– your conduct creates risk for the service or other users
– we need to protect the integrity, security, or operation of the service
– we discontinue part or all of the service
You may stop using the service at any time.
9. Disclaimers
The service is provided on an “as is” and “as available” basis to the fullest extent permitted by law.
We do not guarantee that the service will be uninterrupted, error-free, secure, or available at all times. We also do not guarantee that data loss, bugs, exploits, or outages will never occur.
To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
10. Limitation of Liability
To the fullest extent permitted by law, Fractal Ledger and its operators, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, progress, virtual items, or service access arising out of or related to your use of the service.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the service will not exceed the amount you paid us, if any, for the service during the 90 days before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Fractal Ledger and its operators, affiliates, licensors, and service providers from claims, liabilities, damages, and expenses arising from your misuse of the service, your violation of these Terms, or your violation of another person’s rights.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may provide notice through the website, game, or other reasonable means. Continued use of the service after updated Terms take effect means you accept the revised Terms.
13. Governing Law
These Terms are governed by the laws of North Carolina, designated by Fractal Ledger, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the service will be resolved exclusively in the appropriate state or federal courts in that state, and you consent to that jurisdiction and venue.
